Serial domestic abuser jailed for four months

A repeat domestic abuser who refused to accept his guilt following his latest conviction has been jailed for four months.

Charles Ogilvie, 33, formerly of Waverley Terrace in Arbroath appeared at Forfar on Thursday for sentence having earlier been found guilty of assaulting a woman in Arbroath’s Newton Crescent on December 21 by punching her on the face to her injury.

Ogilvie also admitted a charge of breaching bail, but defence solicitor Robin Beattie said the terms of a social work report in respect of the accused’s attitude towards the assault conviction made his remit “a little difficult.”

“He lives with the victim in this matter, they have been together for six years and there are two previous convictions in respect of the same complainer for breach of the peace and domestic assault,” Mr Beattie told the court.

“Despite the relationship being volatile, Mr Ogilvie maintains that it is a strong and loving relationship.

“There are positives to take from this report…but he doesn’t accept that this took place.

“I have explained that he is rather flying with the crows today.

“If the court was to allow him to retain his liberty then the slightest infraction would see him jailed,” added Mr Beattie.

Sheriff Gregor Murray told Ogilvie: “These are your fourth and fifth domestically aggravated convictions.

“There has been an escalation of domestically aggravated offending in the past year.

“You haven’t learned your lesson.”

The sheriff added: “Because you maintain your innocence following the finding of guilty after trial you limit my options.”

He said that meant Ogilvie could not be considered for the Fergus Programme for domestic offenders,

“I take into account that this was one short incident of short duration and that you are reconciled, but conclude that there is no alternative to custody.”
