Man admits sex attack on woman

A Fife man admitted yesterday at Dunfermline Sheriff Court to carrying out a sex attack on a young woman.

The incident took place in the foyer of one of the three blocks of flats in Broomhead Drive in Dunfermline.

David Miller (32) pushed the woman against a wall, repeatedly seized hold of her, pushed her to the ground and sexually assaulted her.

It was captured on CCTV, and footage of the attack was shown to the court.

Miller pled guilty to assaulting the woman on April 8 this year.

Depute fiscal John Keir told Sheriff Ian Dunbar that Miller had one very minor road traffic offence on his record.

Mr Keir said the 23-year-old woman was followed into the flat by the accused, but she was not particularly concerned by his presence at that stage.

Moments later, though, he began touching her arm —at which point she told him to leave her alone.

Miller then grabbed her and spun her round before pushing her to the ground and assaulting her.

Mr Keir said the woman had the presence of mind to tell her attacker the area was covered by CCTV cameras.

Miller then got up and left, but not before he tore off a piece of the woman’s underwear.

She contacted the police almost immediately after the attack.

One of the police officers recognised Miller from the CCTV footage—he was also recognised by the caretaker of one of the blocks of flats who told the police he lived in a neighbouring block.

When officers searched the accused’s house they found the piece of material from the woman’s underwear in his bin.

“Mr Miller was interviewed under caution, and basically told the police he couldn’t remember a thing,” Mr Keir said.

“He couldn’t even remember leaving The Foundry (a Dunfermline nightclub), where presumably he had been that evening.

“He indicated he had consumed between eight and ten pints and a vodka.”

He added that the woman was relieved the matter had been resolved without her having to appear at court.

Solicitor John Bain told the court his client had consumed a substantial amount of alcohol that evening, and had even been drinking before he went out with friends.

Sheriff Dunbar said, “By any stretch of the imagination this was a horrific attack on this young lady, who must have been quite terrified by what was going on.”

He remanded Miller in custody and deferred sentence until next month.
