No limit on inquiry into boy’s death at pool

THE HEALTH and Safety Executive last night said there was no timescale for the conclusion of its investigation into the drowning of a seven-year-old boy at the Olympia Centre in Dundee.

An HSE spokesman said the Luke Hutton death investigation had thrown up other issues that led to further inquiries having to take place and that was affecting the time being taken.

The St Fergus Primary School pupil’s body was found in September.

It is understood Luke, who could not swim, had been able to enter the pool without an accompanying adult.

The pool had been closed to the public half an hour earlier but the alarm was raised only when a 12-year-old girl, who had been with Luke and another child, realised he was missing.

Police were called and when the pool covers were pulled back, his body was found at the bottom of the deep end.

The HSE has submitted an interim report to the procurator fiscal but could give no timescale on when they are likely to finish the final report.

Once that is completed the fiscal will decide whether court action should be taken.

An HSE spokesman last night said, “We said at the start that our investigation would be thorough and it would take some time.

“It’s proven to be a complex inquiry and one we still can’t really put a timescale on.

“We submitted an interim report to the procurator fiscal a few months ago to let him know the state of play with regards the investigation.

“I think the more we’ve investigated, the more we’ve found we need to look at. That has widened the scope of our investigation.”

Police have finished their examination and submitted their report to the fiscal in January.
