Drunken night ended in arrest

A PERTH man was arrested for a boozy breach of the peace after he reported himself to the police.

Perth Sheriff Court heard how Duncan McPhee shopped himself when a night out drinking with his uncle ended in an unsightly argument.

The 21-year-old, of High Street, Kinross, was fined after pleading guilty to conducting himself in a disorderly manner, shouting and swearing and committing a breach of the peace at Leslie Street in Perth.

Depute fiscal Stuart Richardson described it as a “somewhat unusual” case.

“It was about 12.45am on a Wednesday morning when staff at the police control room received a message by telephone,” he told the court.

“The phone call was from Mr McPhee who said police better attend because he was, in his own words, a racist.

“The operator could hear what appeared to be a disturbance in the background and two officers were dispatched to the scene.”

When the police arrived they found McPhee standing in the street.

“The officers asked the accused if he had phoned the police and for whatever reason he just began to shout and swear.

“He would not stop and was arrested.”

Solicitor Paul Ralph confirmed that McPhee, who works as a gardener, was intoxicated at the time of the incident.

“Mr McPhee had been out drinking with his uncle and had gone back to his uncle’s house,” he explained.

“His uncle’s wife started arguing with her husband due to their drinking and Mr McPhee tried to calm things down.

“He phoned police and then went out into the street.”

Mr Ralph said police went to arrest McPhee’s uncle but the accused “got involved” and ended up being lifted himself.

Sentencing, Sheriff Robert McCreadie branded the offence “disgraceful.”

“Having regard to all the circumstances you will be fined £300,” he said.

“This was a disgraceful manner in which to behave toward the police.”
