A Dundee father and son have been put behind bars for their part in a brutal assault in the city centre.
At Dundee Sheriff Court on Tuesday, Lee Lynch (20), Fleming Gardens East, and Gordon Joseph Lynch (48), Ancrum Court, both admitted an indictment that on October 4, 2010, at the Shell Garage, West Marketgait, they assaulted John Munro, c/o Tayside Police, punching him on the head, striking him on the head with a bottle, seizing him by the neck, repeatedly punching and kicking him on the head and body, all to his injury and permanent disfigurement.
The court heard the two accused, Lee Lynch’s mother Marina Rankine and another male were in the garage shop at around 2.30am after being out drinking. Mr Munro, who was unknown to them, had gone into the shop and moved through them to get to the till area. A verbal exchange took place which then led to an altercation between the parties.
Lee Lynch punched Mr Munro twice, then Gordon Lynch took a beer bottle from his pocket and smashed it over Mr Munro’s head. Lee Lynch then held the victim while Gordon Lynch punched him five or six times on the head and body, then kicked him four or five times on the body while he was still being held and was bent over.
Police arrived and found Mr Munro in the shop, bleeding from a head wound. Lee Lynch told police Mr Munro had assaulted his mother but this account was not matched by CCTV evidence.
Mr Munro suffered a 3cm laceration to the right side of his head which required paper stitches and has left a permanent scar.
Sheriff Elizabeth Munro jailed Gordon Lynch for 27 months.
Lee Lynch was sent to detention in a young offenders institute for nine months for his part in the assault.
The 20-year-old was then given a further four months’ detention to be served on completion of the nine-month sentence after admitting another assault, on August 7, 2010, in North Lindsay Street, on Lee Bulloch, c/o Tayside Police, by punching him on the face and knocking him to the ground, to his injury.
