Instead of tying the knot in Texas, Jason Herkes (31), of Baldinnie, Ceres, could find himself instead sitting in the dock at Cupar Sheriff Court. He could be ordered to remain in Scotland after a sheriff questioned the timing of his booking arrangements. Sheriff Charles Macnair is concerned Herkes booked the holiday even though he knew he was due in court at the same time. The issue was raised during a brief accelerated diet hearing at the court on Thursday. Herkes was absent as his solicitor said: ”He is due to leave Scotland on December 12 and is not due to return until January 18.” The trial had been pencilled in for January 16, with witnesses potentially unavailable after that date. Sheriff Macnair continued the case for a week for further inquiries to be made. Herkes denies that on February 12 he refused to give a specimen of breath to officers who suspected him of driving while under the influence.
