A couple have been unable to sell their home in Killin due to a planning restriction stating the new resident must be a farmer.
Darach, owned by Stuart and Ruth Kelloe, has been on the market since June 2024 for offers over £575,000.
Despite interest from three different parties, the four-bedroom property has failed to sell as it comes with an agricultural occupancy restriction.
This means the resident must be someone who is solely, mainly or was last employed in agriculture.
It could also be inhabited by the spouse, ascendants, descendants or family of a farmer.
The couple are now seeking permission from Loch Lomond and the Trossachs National Park Authority to remove the restriction so they can successfully sell the home.
Agriculture condition preventing Killin sale
Mrs Kelloe’s parents received the go-ahead to build the house in 2012 and it was completed in 2015.
The family’s business, M Campbell & Sons, managed farmland at Acharn and were tenant farmers on a hill farm five miles away.
There is currently no agricultural business associated with the property as Mrs Kelloe’s brother gave up tenancy of the hill farm in 2018 and the applicants are also no longer involved in the farm.
Galbraith began marketing the four-bedroom villa a year ago.
It comes with 17.65 acres and ground suited for grazing or keeping cattle.
Farningham Planning, agent for the applicants, claim since going up for sale only three parties have shown serious interest in the Killin property.
Two backed out due to concerns over and issues obtaining finance from a lender caused by the residency condition.
The third interested party, a former gamekeeper looking to establish a deer and vermin control contracting business, withdrew an offer as he was not classed as an agricultural worker.
Farningham Planning also says a business not yet established would not fall within the terms of the condition.
Loch Lomond and the Trossachs National Park Authority will determine the planning application.
