Arbroath sex offender jailed after court hears victim ‘slept in locked cupboard’

An Arbroath sex offender who molested two girls, 20 years apart, has been jailed.

Scott Galloway, 63, sexually assaulted his first victim when she was just 12 at an address in Dundee.

His second, who he violated two decades later, was 13.

First offender Galloway, of Bank Street, Arbroath, was found guilty after trial of committing a lewd, libidinous and indecent practice towards a girl at an address in Dundee for about a year and a half during the 1970s.

He was also found guilty of using libidinous, lewd and indecent practices and behaviour towards another girl, then aged over 12 and under 16.

One of his victims, who woke in the middle of the night to find Galloway molesting her, recalled how she locked herself in a cupboard to stop him from attacking her again.

Tried to kiss first victim

His first victim was only 12 when he touched her inappropriately at his flat in Dundee in the mid-1970s, the trial heard.

He told her to “pretend I am your boyfriend”.

Giving evidence, the woman, who cannot be named for legal reasons, said she woke to find Galloway “trying to kiss” her.

“I was in bed, he was beside me. He tried to kiss me.

“He asked me to pretend I was with my boyfriend.

“I can’t remember anything past that.

“I did not like it at all.”

Second victim slept in locked cupboard

His second victim recalled how, in the mid-1990s, she had woken in her bed in Aberdeen with Galloway crouched beside her.

He was touching her inappropriately under the covers.

“I felt something moving between my thighs,” she told the court.

“I then quickly realised there was a hand between my legs.

“After a moment I woke up. He was kneeling at the side of my bed. His hands were under the blanket.

“He said I was making a noise and had come to check on me.”

She said: “He then came back 20 minutes later and I sat right up and asked him why he had come back into my room.”

The girl slept in another room the next night, inside a cupboard which had a lock on it.

“I was scared he was going to come back to the room again.

“I put the chain lock across the cupboard door.”

Prison ‘appropriate’

Sentencing Galloway to three months in prison, Sheriff Lindsay Foulis said he could only punish the sex offender with the methods available at the time.

“Both of these offences, committed by you, happened some time ago – the first in the 1970s and the second in the 1990s.

“But I do not wish to be dismissive of the consequences for your victims.

“Your behaviour, she will throughout her life, have to revisit.

“You were in a position of trust.

“There was a much more significant age difference between you and the girl in the second charge.

“The maximum sentence which could have been imposed at the time is three months in custody. It seems appropriate.”

Defence solicitor Grant Bruce, in mitigation, said: “The offences took place some time ago.

“The risk assessment carried out appears to show a low risk of Galloway committing further offences.”

Galloway was sent to prison for three months and placed on the Sex Offenders Register for seven years.
