Wednesday court round-up — Dundee teen detained after rape verdict

A teenager has been jailed after a jury convicted him of sexually assaulting a 12-year-old girl and raping a 13-year-old child on the same day in woodland in Dundee.

The youth, who cannot be named for legal reasons, targeted the children in the Ardler area on February 10 2023.

The High Court in Edinburgh heard how the youth was 15 years old at the time. He is now 17.

The court heard how he approached the 12-year-old girl and seized her by the arm, before pulling down her clothing and carrying out a sexual assault.

The youth also approached the 13-year-old child and pulled down her lower clothing before raping her.

He was found guilty of rape and sexual assault charges after denying any wrongdoing.

Judge Michael O’Grady KC was told the accused had no previous convictions.

Defence solicitor advocate Jim Stephenson said he would not say anything more until sentencing proceedings later this year, after background reports have been prepared.

Judge O’Grady remanded the youth in custody.

He said: “You have been convicted of very serious offences. Rape of another person is serious as it can have untold consequences on complainers.”

£58k dealer

A drug-dealer is back behind bars after being caught with cannabis worth more than £58,000 in his Dundee home. Kevin Martin, 36, allowed others to use his address on Milnbank Road to store almost 100 plants and bags of herbal green matter.

Drink-drive ‘aberration’

A driver caught coming home from a wake in Montrose while five-and-a-half times the drink-drive limit has been banned from the road.

June Aitken, 51, appeared at Forfar Sheriff Court to plead guilty to driving with excess alcohol (119 mics/22) on June 13.

First offender Aitken was caught by police near her home on Bridge Street, Montrose, after a member of the public saw her swerving across the road.

Solicitor Nick Markowski said: “It’s a fairly high reading but there’s no underlying issues.

“It was a Friday. She was stopped at about 10.30pm to 11pm.

“She’s no idea why she took the car. She’s driven less than a mile and past the police station.

“She appreciates she’ll lose her licence. It does appear as an aberration on her part.”

Sheriff Jillian Martin-Brown banned Aitken from driving for a year and fined her £355 altogether.

Over-amorous

Notorious dine-and-dash restaurant raiders have wound up back in the dock together to admit having sex near Arbroath harbour. Kerry Anne Smith and Sean Dempsey admitted a charge of public indecency after having sex on a grassy area and against a bench on Old Shore Head, close to the town’s pumping station.

Robbery charges

Two people appeared in private accused of assault and robbery in connection with an incident in Brechin.

Jay Potter, 31, from Glasgow and 33-year-old Angela Newlands from Angus appeared at Forfar Sheriff Court.

Both were accused of assault to injury and robbery and a second charge of attempting to pervert the course of justice.

Neither entered a plea and were committed for further examination.

Potter was remanded and Newlands granted bail.

The court appearance came after police said arrests had been made in connection with an alleged robbery in the town’s Montrose Street on Monday night.
