A man accused of breaking into, and stealing, from a fatal fire victim’s flat has been released on bail after his trial came to an abrupt halt at Kirkcaldy Sheriff Court.
Kevin Stewart, 41, a prisoner in Perth, denied breaking into the Leven flat of Scott Kerr on March 3 last year and stealing a TV, an Xbox computer console, controller and games.
Mr Kerr, 32, had been found dead just days earlier after a blaze swept through his upstairs flat in Waggon Road.
The court heard on Friday that an issue had arisen overnight which required discussions between Sheriff Jamie Gilchrist QC, fiscal depute Ronnie Hay and defence solicitor Dewar Spence.
All three parties agreed that the trial could not continue and the jury was discharged.
