A man who breached a curfew imposed the day before after failing to be prescribed Methodone was jailed for 60 days by Sheriff John Rafferty.
William Hutchison, 48, of Brantwood Avenue, admitted breaching the 7pm to 7am curfew at Dundee and Angus College on November 8.
The court heard he had been placed on the curfew on Tuesday, November 7, after being released from custody on another matter to await sentence next month.
Hutchison had admitted that on October 14, 2017, in a police vehicle en route to Bell Street HQ, he behaved in a threatening or abusive manner likely to cause fear or alarm, sang songs, swore and uttered offensive remarks, which were aggravated by religious prejudice.
The court heard then that the accused had been taken into custody and en route to Bell Street HQ he began singing sectarian songs and using offensive words and continued in the waiting room at Bell Street, swearing and uttering offensive remarks regarding Fenians, the Pope, Muslims, Asian people and Isis.
On his latest appearance, solicitor Paul Parker Smith told the court Hutchison had struggled with drug addiction for many years.
He had been on Methodone in prison and that was supposed to be transferred to the drug problem centre.
However after being released from prison he went there but was unable to be receive any and was having withdrawal symptoms.
He lost track of time, the solicitor said and he found himself in the local college, not far from where he stays.
Mr Parker Smith told Sheriff Rafferty Hutchison was realistic and although he would comply with a bail condition if he was granted bail for reports, if the Sheriff was thinking about custody Hutchison would prefer the case to be dealt with immediately and be given a prison sentence rather than be placed on remand.
Sheriff Rafferty said: “You were granted bail on November 7 and you breached that bail order almost at the first available opportunity.
“The only appropriate and the best thing I can do is impose a custodial sentence until after the December 5 diet when reports will be available and the sheriff will consider what happens to you then.”
He jailed Hutchison for 60 days.
