An Angus window cleaner who assaulted his partner on Christmas Day is to spend this festive season behind bars.
Kevin McKinlay, 37, of Strathmore Avenue, Forfar, was jailed for five months when he appeared before Sheriff Gregor Murray at the town’s sheriff court.
At an earlier court hearing he admitted assaulting his partner at an address in Auchmithie by pinning her down on a bed and seizing her by the body and by the throat on December 25 2017.
In May he was sentenced to a community payback order but failed to meet the conditions or comply with social workers.
He also breached bail conditions granted on January 16 2018 at Forfar Sheriff Court by approaching his ex-partner in the Forfar Asda Store on February 12 2018.
Depute fiscal Bill Kermode told the court McKinlay and his partner had had an “on-off relationship” for three years.
He had been accused of selling property belonging to the complainer.
He had been drinking on Christmas Eve and at around 8 or 9pm he and his partner started to argue about her association with someone he did not like.
He said: “This continued for a few hours. At around 1am the complainer was lying in bed and took a phone call and realised he (McKinlay) was on the phone too.
“He placed his hands on her throat, all this was heard by the other person on the phone.
“The complainer kicked him off and he left the bedroom. The police were contacted and arrived at 1.20am where they found him in the garden.
“He had superficial cuts and said he had fallen. The complainer had a large bruise on her upper arm. When arrested, the accused said ‘it’s all lies’.”
McKinlay’s solicitor Ian Flynn told the court his client accepted he acted badly.
He said: “This was a volatile relationship. He has moved to Forfar to get away from it.
“He wants to get back to his window cleaning business. Their relationship is totally over.”
Sheriff Murray noted McKinlay’s lack of communication with Angus Council’s social work department regarding the original community payback order for the assault charge.
He said: “You are no stranger to jail, I revoke the community payback order and sentence you to four months in prison.
“I also sentence you to 30 days for the breach of bail to run consecutively.”
