A Dundee man who got his step-daughter pregnant is facing jail.
The man – who cannot be named to protect the identity of his step-daughter and her child – had been married to the woman’s mother for 10 years before they split up in 2005.
However he continued to visit his step-children at the family home in Dundee.
Dundee Sheriff Court heard on Tuesday that on two occasions he found his step-daughter home alone.
He made “sexual advances” before having sex with the woman, aged 27 at the time.
Depute fiscal Vicki Bell told the court: “He was a regular visitor and let himself in using a key.
“On two occasions he found the complainer alone and on both occasions she was dressed only in a nightdress.
“On both occasions he made sexual advances and had sexual intercourse with her.
“She then became pregnant and gave birth to a daughter in 2012.
“After birth she disclosed to her mother he had had sex with her and believed he was the father of the baby.
“He was interviewed and made no comment.
“DNA was taken to establish paternity and they confirmed he was the father.”
The 60-year-old, of Dundee, pleaded guilty on indictment to a charge under the Criminal Law (Consolidation) (Scotland) Act.
The offences were committed between October 1 and October 31 2011.
Defence advocate Neil Beardmore said: “In 20 years of doing this I have never prepared a case like this before.
“I am aware of a report from the Scottish Law Commission which recommended this particular section of law be abolished.
“But for the marriage this would not be a crime.”
Sheriff Alastair Brown said: “But for Abraham Lincoln’s assassination, Mrs Lincoln would have enjoyed the play.”
The sheriff deferred sentence until next month for social work background reports and released the accused on bail meantime.
He added: “Not only was there an element of trust but also a vulnerability as I’m told she had mild learning difficulties.”
