The owners of a caravan park have been charged following the death of a six-year-old boy who was found unconscious in the swimming pool at the site.
Aidan Yule, from the Kirkton area of Dundee, was spotted at the bottom of the pool at the Red Lion Caravan Park in Arbroath on June 18 2011.
He was rushed to Ninewells Hospital but the Mill o’ Mains Primary School pupil died four days later.
Both Angus Council and the police carried out a joint investigation into all the circumstances of the incident and submitted their findings in a prosecution report to the Crown Office.
The matter has been considered by the Crown Office’s health and safety division and following the consideration of all the facts, Loch Earn Caravan Parks Ltd – which owns the site where the tragic discovery was made – has been charged.
The case is due to call for the first time at Forfar Sheriff Court on Wednesday.
Loch Earn Caravan Parks Ltd declined to comment.
On the day of the incident, it was reported that Aidan’s mum raised the alarm initially and a member of the public administered CPR when he realised the boy wasn’t breathing.
Paramedics worked on Aidan, who lived on Beauly Avenue, for 40 minutes before he was taken to Ninewells by ambulance with a police escort.
Aidan was treated at intensive care in Ward 20 but failed to recover and died four days later in the arms of parents Mandy Sands and Kevin Yule, while also surrounded by siblings Kevin, Angel, Shannon and Dylan.
His passing was widely felt across Dundee with his classmates being offered support to help with their grief.
The family later launched their own legal action against Loch Earn Caravan Parks Ltd, which has its head office in Errol.
Following the death of Mandy in 2013, her parents Tom and Kathryn took over responsibility of the case.
It was understood they are suing the company for more than £50,000.
