‘Come on, I’ve got my chopper out’ — Semi-naked man who answered door to Fife delivery driver could be placed on Sex Offenders Register

A man who answered the door with his genitals exposed to a young female delivery driver will be sentenced later this month.

Lee Halpin, of Charles Street in Alloa, got out of the shower and answered the door while naked from the waist down.

He had been drinking with a friend at an address in Dunfermline on October 25, 2019.

The 28-year-old’s conduct, including a lewd remark, could see him branded a sex offender.

He admitted acting in a threatening manner by answering the front door at Kirklands in Dunfermline in a state of undress and making indecent remarks.

‘Get in here’

At Dunfermline Sheriff Court, Fiscal depute Azrah Yousaf said: “It’s a delivery driver who attends his home address.

“He attends at the door wearing only a t-shirt.

“His private member is visible.

“He points at it and saws: ‘Awww come on, I’ve got my chopper out. Get in here’.”

Halpin’s defence solicitor stressed he “had no other motive than stupidity.”

While acknowledging a friend with whom he was drinking knew the delivery driver, his defence solicitor stressed the incident was not planned and Halpin had not been the person who ordered the package.

Sheriff Alastair Brown said: “The accused presented himself at the door wearing only a t-shirt, made a remark and called attention to his private parts.

“She is confronted with the accused who is exposed and who, far from attempting to cover himself up or apologise, says ‘oh come on I’ve got my chopper out, come in.'”

The sheriff stated his behaviour was offensive and “probably alarming” to the young delivery driver.

“It is, from her point of view, a sexual demand. How else can it possibly be construed?”

Previous conviction

Dunfermline Sheriff Court heard Halpin has a previous public indecency conviction for urinating in public.

Halpin’s solicitor, however, described the remark as a “one-off comment.”

Sheriff Brown said he had to determine whether there was a significant sexual element before deciding whether or not to place Halpin on the Sex Offenders Register.

Depute Fiscal Laura McManus stated: “It is the Crown’s position that there is a significant sexual element:

“The accused chose to present himself at the door and chose to in a state of undress.

“He chose the words he uttered towards the complainer.

“The randomness or impulsiveness that he showed give concern.”

Sheriff Alastair Brown deferred sentencing until July 27.
