Cupar man facing prison sentence after breaching internet ban to post Sheku Bayoh video

A Cupar man is facing jail after he breached an internet ban by sharing a video about Sheku Bayoh on Youtube.

Jamie Duchain, of Balgarvie Crescent, was made subject to a community payback order after he was caught with child abuse images in 2016.

The 40-year-old was ordered to comply with the sex offenders notification requirements but breached them by leaving the country.

The order was reimposed by Sheriff James Williamson who ordered a complete internet ban on Duchain unless he was using a computer at Kirkcaldy public library.

However, he admitted breaching the order by posting a Youtube video about Mr Bayoh in June this year from his mother’s home in England.

Defence solicitor Kerr Sneddon previously told the court: “He fixates on something and he does something daft. The seriousness is not lost on him.

“At his home, he has reminders around him not to do certain things. He has post-it notes as a reminder.

“He went down to his mothers where there are not the same checks and he was out of his comfort zone.

“He posted a video on Youtube about Sheku Bayoh on the basis that he felt strongly about it.”

Duchain was also found guilty of having file wiping software on a tablet device at an address on Balsusney Road in Kirkcaldy on March 29 last year.

Sheriff Alastair Thornton yesterday warned him he was “on very thin ice” and facing a custodial sentence for the offences.

He deferred sentence until January 14 for background reports.
