Angus man jailed for bottle attack

An Angus man has been jailed for more than two years after admitting a bottle attack and having a knife in a public place.

Kevin Hutcheon, 29, described as a prisoner at Perth, had previously been jailed for stabbing a dog.

He previously admitted at Forfar Sheriff Court that on November 6, 2014, in Ferry Street, Montrose, he assaulted a man, striking him on the arm with a bottle, whilst on bail.

He further admitted being in possession of a knife in a public place in Union Street, Montrose, the following day.

The court previously heard the assault victim was 18 when he was approached in the street by Hutcheon who asked him his name.

When the victim confirmed who he was, Hutcheon walked towards him with a bottle, and, without warning, struck him on the arm with it. The victim was not injured as a result.

The following day police were called to a disturbance and Hutcheon was detained.

A search was carried out and a knife fell out of Hutcheon’s right hand and landed on the street between his legs.

Defence agent Ian Flynn said: “He said he picked up the knife so that it could not be used on him. He should have let it lie.”

The court previously heard it was a kitchen-style knife of about four inches, with a cutting blade of three-and-a-half inches long.

While sentencing on Thursday, Sheriff Pino Di Emidio said Hutcheon, who had been remanded in custody since November 10 last year, had an “unenviable” record.

He said: “You have previous convictions in relation to possessing knives and the court has to take a serious view of that matter.

“I sentence you to 28 months’ imprisonment, discounted to 26 months because of your plea, and that is backdated to November 10.

“In addition, giving regard to your record and to protect the public, I will add a supervised release order on your release from custody for a period of nine months.

“During that period you will report to a supervising officer. If you breach this order you are likely to be brought back to court and remanded in custody.”
