A boozed-up Fife man has been jailed for two years after pleading guilty to whipping his victim with a metal chain on the day he celebrated being freed on bail.
Mark Dolan, 25, left David Simpson with welts on his body after an alcohol-fuelled argument spiralled out of control.
Dolan, a prisoner in Edinburgh, then used the chain to smash the windows of a nearby car at Dunearn Drive, Kirkcaldy, on July 24.
Dolan’s solicitor said his client had been drinking to excess to celebrate being liberated at Kirkcaldy Sheriff Court earlier that day.
He said: “He shouted that this was his street and he owned it. Mr Simpson said this was not the case.
“There was a brief physical altercation between Mr Simpson and my client’s younger brother and this was when the accused got involved.”
Dolan also faced a further charge that he assaulted his then girlfriend at an address in Dunearn Drive on June 14, by seizing her by the body, pushing her to the ground and seizing her by the throat, to her injury.
His solicitor stated: “An argument took place as Mr Dolan had taken valium as well as alcohol.”
Sheriff Max Hendry said: “I think you are well aware, at the age of 25, that the way you’ve been acting over the last 10 years does not leave the court with any other option other than a custodial sentence.”
