Dundee drink driver who stole van was ‘unsteady on his feet’ and threatened to kill police

A man stole a transit van and drove it while five times the legal alcohol limit before repeatedly spitting at police officers and kicking inside their police van.

Stanley Marnie, 31, of the city’s Kilberry Street, was jailed for eight months and disqualified from driving for two years at Dundee Sheriff Court.

Prior to the chain of events, Marnie was getting a lift from an acquaintance, named in court as Mr Sime.

Fiscal depute Laura Bruce told the court there was “an altercation” on the street between Mr Sime and a group of males.

Kilberry Street

As a result Mr Sime left his Ford Transit van with Marnie and the keys inside.

The fiscal said: “The complainer was down the street.

“He heard the vehicle being revved and went up the street and the van was gone.”

Police were contacted and Marnie was seen driving the van and parking it at Kilberry Street.

The fiscal continued: “Officers saw Marnie exit the vehicle and place the keys in his back pocket.

“He was unsteady on his feet. Police approached him and he admitted that he had been drinking.

“He became aggressive and began shouting and swearing at officers, he said “I’ll kill you” and spat at them.”

Marnie was restrained on the ground and a spit hood was put on him before he was put inside a cage in the back of a police van.

He headbutted and kicked the inside of the van.

At police headquarters, Marnie gave a reading of 109mics of alcohol in 100ml of breath.

Solicitor Doug McConnell, defending, said: “This offence is a return to behaviour which caused him so much trouble before.

“The problem is misuse of alcohol, which turns him into something which he is not. He takes alcohol to excess and does things like this.”

Marnie admitted stealing a van, driving without insurance and driving while five times the legal alcohol limit, all at Kilberry Street, on August 28.

He also admitted assaulting PC Daryll Plantinga and PC Mark Guild, by repeatedly spitting on their bodies, and aggressive behaviour by uttering threats to kill the officers, butting a detention cage wall within a van and repeatedly kicking the cage.
