Vicious Dundee pub attack lands man in prison

A man has been jailed after he carried out an unprovoked bottle attack on a Dundee man in a pub.

Barry McAreavey, from Cardonald, admitted that, on June 28, in the Balcony Bar on the city’s Ward Road, he assaulted Stephen Hardie.

And the 34-year-old was caught after he flagged down a police car the next day to ask for directions.

The court heard that McAreavey, whose address was given as HM Prison Perth, had been working in Dundee as a pipefitter at the time of the offence.

CCTV footage of the attack was played in the court.

It showed McAreavey and a colleague arriving in the bar, where Mr Hardie had been drinking alone.

Fiscal depute Saima Rasheed told the court: “At around 8pm, the accused and another male approached the bar area and were there for several minutes, during which time they engaged in banter with Mr Hardie. Mr McAreavey made a joking remark about Dundonians not liking people from Glasgow.

“Mr McAreavey then became more animated, joking and putting his arm around Mr Hardie.

“Suddenly, and without provocation, he struck Mr Hardie once to the face with a bottle, then headbutted him multiple times.”

The pub’s staff intervened and separated the two, and McAreavey’s colleague was seen on the tape apologising before the two left the bar. The attack left Mr Hardie with a large haematoma above his eye and a cut to his nose.

McAreavey was apprehended the following day in Commercial Street after he flagged down a police car to ask directions to a shop.

The officers realised McAreavey matched the description of the attacker and arrested him. He refused a breath test at West Bell Street Police Station, and was further charged with failing to provide a specimen of breath.

McAreavey admitted assaulting Mr Hardie by seizing him by the neck, striking him on the head with a glass bottle, repeatedly punching him, struggling with him and repeatedly striking him on the head with his head, all to his severe injury.

Sheriff Alastair Carmichael jailed McAreavey for 12 months for the assault, backdated to June 30 when he was remanded in custody. He was also disqualified from driving for 12 months.
