Birthday in court for man after bottle attack in Montrose

A man once jailed for stabbing a dog has admitted a bottle attack and having a knife in a public place.

Kevin Hutcheon described as a prisoner at Perth, spent his 29th birthday in the dock at Forfar Sheriff Court and pleaded guilty to two charges.

The case was due to go to trial before a jury until an 11th hour plea was made through defence solicitor Ian Flynn.

Hutcheon admitted that on November 6 last year, on Ferry Street, Montrose, he assaulted a man, striking him on the arm with a bottle, while on bail.

He further admitted being in possession of a knife in a public place on Union Street, Montrose, the following day.

The court heard the victim of the bottle attack was 18 when he was approached in the street by Hutcheon who asked him his name.

When the victim confirmed who he was, Hutcheon walked towards him with a bottle, and, without warning, struck him on the arm with it.

The glass bottle itself smashed on the ground and the victim was not injured as a result of the assault. The following day police were called to a disturbance and Hutcheon was detained.

A search was carried out and a knife fell out of Hutcheon’s right hand and landed on the street between his legs.

It was a kitchen-style knife of about four inches with a three-and-a-half-inch blade.

The Crown asked for the forfeiture of the knife after it was presented to Sheriff Pino Di Emidio on Monday.

Solicitor Ian Flynn said: “Today is his 29th birthday and he appears in court.

“His previous convictions don’t make good reading.”

Sentence was deferred until February 26 for background reports. No motion was made for bail and Hutcheon was remanded in custody.

Hutcheon was previously jailed for 21 months at Forfar Sheriff Court in December 2013 for repeatedly stabbing a dog in Montrose.

When police arrived at the scene they found the staffordshire bull terrier with multiple injuries and covered in blood.

Despite its wounds, the animal survived the attack.
