Drunken Kirkcaldy man jailed for threatening police

A Fife man, who on three occasions was found lying drunk in the street and then abused police officers who went to his aid, has been jailed for 16 months.

David Berry, 45, c/o the Bridgeway Hotel, Mill Street, Kirkcaldy, appeared at Dunfermline Sheriff Court for sentencing for the three incidents.

On October 1 on Bridge Street, Kirkcaldy, he behaved in a threatening or abusive manner by shouting, swearing, making threatening gestures and threatening officers and their families.

Depute fiscal Azrah Yousaf told the court the officers found Berry lying in the street near a shop. After five minutes of trying to get him up, Berry was shouting anti-English abuse and using Nazi slurs.

On October 5, on Kirkcaldy High Street, Berry behaved in a threatening or abusive manner by shouting and swearing at police trying to help him.

Ms Yousaf said on this occasion officers had received a report about a man who had appeared to have fallen and struck his head.

On October 19, at Guildhall Street, Dunfermline, Berry again behaved in a threatening or abusive manner by shouting, swearing, making threats and assaulting a police officer by repeatedly spitting on him.

The depute fiscal said Berry had been found lying unconscious in the street and police arrived to find him shouting and pointing at members of the public.

He shouted at passersby: “What are you looking at? I’ll come over there and do you.”

Defence solicitor Roshni Joshi said her client suffered from back pain and drank alcohol to ease the discomfort.
