A Dundonian who exposed himself in front of a terrified sunbather has had his name added to the sex offenders register.
Cupar Sheriff Court heard George Hart’s victim was on a day out at Kinshaldy Beach when the 47-year-old lowered his trousers and underpants.
She eventually fled the scene after Hart, of Ann Street, Dundee, exposed himself while repeatedly saying: ”You are beautiful.”
Depute fiscal Brian Robertson told Cupar Sheriff Court: ”This occurred on a public beach, which is a well known beauty spot, particularly used by families during the summer period.
”There is an area of the beach which is notorious as a nudist beach, although that is not something which is recognised by the local community or the police.”
Mr Robertson said the sunbather was reclining with a hat over her face when the accused approached.
”She was lying in the dunes when the accused walked past her at about 12.30pm,” the depute fiscal continued. ”The complainer saw the accused was about 10 feet away when he started saying: ‘You are beautiful.’
”She then saw him acting in the manner libelled in the charge.”
The sunbather told Hart to go away and warned him she would be contacting the police.
”The accused then walked away and the complainer returned to her vehicle, which was about three miles away,” Mr Robertson said. ”She got in touch with the police … and was able to identify the accused.
”When interviewed by police later, the accused said: ‘She looked like she was intending to attract attention. She was inviting it … I told her she looked beautiful. I made a mistake’.”
Solicitor Alan Davie said Hart could ”offer no explanation” for his behaviour.
”He is aware that he will be placed on the sex offenders register as a result of this,” the defence agent added.
Sheriff Jack Brown deferred sentence until December 1 for reports and confirmed Hart’s name would be added to the register meantime.
Hart was released on bail, a condition of which stipulates he must not travel within 100 yards of Kinshaldy Beach.
