A 24-year-old man who engaged in a sex act in the lifts of two Dundee multi blocks has been jailed.
Sean Smart, of Rosebank Street, was jailed for nine months at Dundee Sheriff Court after admitting he engaged in the lewd act in the public lifts at Dallfield Court and Bonnethill Court, on October 17.
Co-accused Arlene McTaggart, 27, of Dallfield Court, was previously fined £200.
Sheriff Tom Hughes told Smart he faced a more serious sentence due to his previous convictions, failure to appear at court when the case last called, and off the back of a second charge he had pleaded guilty to carrying a knife.
In relation to the sexual charge, solicitor Sarah Russo, defending, said: “He had consumed vast amounts of cider. He is remorseful and very embarrassed.”
She added that an assessment by professionals who work with sex offenders stated he was not a person pre-occupied by sex and therefore not suitable for a rehabilitation programme.
Sheriff Hughes said Smart would not be placed on the sex offenders register in relation to the charge.
The court heard previously the pair were caught on CCTV around 8.15pm on October 17 at Dallfield Court by police officers and a concierge.
Depute fiscal Eilidh Robertson said: “While this was happening, Smart was pressing buttons on the lift to go up and down, stopping at numerous floors.
“Thereafter, they attended the lifts of Bonnethill Court, went into another lift and continued in the same fashion.
“Nobody was ever at the doors when they opened, but they are busy multi-storeys and there was the potential for a number of individuals to be at those floors.”
Smart also admitted carrying a lock-knife without reasonable excuse or lawful authority on December 17 2012, at Albert Square.
Smart was sentenced to nine months for carrying an offensive weapon, and four months for engaging in a sex act in a public place, both to run concurrently.
