A Montrose man who struck another man with a plastic glass in a Dundee nightclub was detained for a year, despite being a first offender.
Sheriff Alastair Brown told Joe Officer, 20, that “nothing short of a custodial sentence is in any way adequate or appropriate.”
He also banned Officer from entering Fat Sams nightclub for three years.
Officer, of George Street, Montrose, admitted committing the offence on April 27, striking Mark Dollan on the head with the plastic glass to his injury and permanent disfigurement.
The court heard he was in the club with two other men and was seen by a doorman to speak to Mr Dollan and his friend, who were dancing with an unknown woman.
They invited the two into the VIP area, where the accused told Mr Dollan’s friend to go and get the woman to join them otherwise he and Mr Dollan would be assaulted. The doorman was watching and saw the conversation becoming heated and then Mr Dollan and his friend made their way to the dance floor, followed by the accused, who was carrying the plastic glass.
As Mr Dollan turned round, the accused struck him in the face with the glass, causing a large deep laceration to Mr Dollan’s face.
The doorman escorted Officer to waiting police officers, who arrested him, while Mr Dollan was taken by ambulance to Ninewells Hospital where he received five stitches.
Solicitor Gary McIlravey said Officer had earlier asked a security guard to eject Mr Dollan, but his request was declined and he took matters into his own hands.
Sheriff Brown told Officer he took into account he was a first offender and his early plea, but told him he would be sent to detention for 12 months due to the seriousness of the offence.
