Man jailed for threatening neighbour with knife

A Rosyth man who threatened a neighbour with a knife has been jailed.

Darren Toshack, 22, was so drunk that afterwards he could not remember what he had done, Dunfermline Sheriff Court heard.

Toshack admitted that on December 27 last year at Sherbrooke Road, Rosyth, he conducted himself in a disorderly manner, make excessive noise and thereafter shouted, threatened violence, brandished a knife, made challenges to fight and committed a breach of the peace.

Depute fiscal Fiona Nairn said Toshack was seen and heard banging on the door of a house in the street at around 5.30am.

He was banging for 45 minutes before another neighbour heard the sound of glass smashing. She looked out of the window and saw Toshack running away.

At around 8.30am Toshack was making more racket in the street and a male neighbour asked him to keep the noise down as his five-year-old daughter was sleeping.

An argument ensued and the neighbour saw that Toshack had a knife in the pocket of his tracksuit trousers. Toshack took out the knife and shouted ‘Come on then’ as he moved towards the man’s house.

Solicitor Gordon Martin said his client’s girlfriend also lived in Sherbrooke Road and it was her door he was banging on.

“He’s fortunate nothing further happened and he’s appreciative of that,” added Mr Martin.

Sheriff Charles MacNair told Toshack: “Producing a knife and challenging someone to fight, particularly when someone is drunk, escalates the offence to a very high level.”

Toshack, who had been living in Paul Street, Lochgelly, since the incident, was jailed for 160 days.
