Pensioner who says he spent night in bin will sue bus firm

The Dundee pensioner abandoned in Fife by a bus driver has announced he will take legal action against Citylink.

Lawyers acting for Henry Stewart, 70, said they would be suing for “breach of contract and negligence”.

Mr Stewart told The Courier he’d been dumped at Halbeath Park and Ride and forced to spend the night huddling for warmth at the height of Storm Desmond.

The veteran was to have been taken to Edinburgh for a transfer to the city’s airport and a flight to Malta for a much-needed holiday with friends. Instead he had one of the most uncomfortable nights of his life and said he had huddled in a recycling bin for warmth.

Citylink continues to dispute elements of Mr Stewart’s account but has admitted there were failings in the service provided to him.

The firm paid for another flight, together with an extended stay in Malta and transfers from his home and back to ensure he did not miss out.

Though happy that his holiday took place, Mr Stewart said the additional compensation of just £83.50 offered was unacceptable.

“Citylink has taken action but nothing they have done compensates me for what I went through,” he said. “Had I been frailer I could have come to serious harm.”

Solicitor Billy Boyle, of Boyles Solicitors, said: “We will be acting for Mr Stewart and are suing for breach of contract and negligence.”
