Dundee’s Tally’s Bar has been given until January to install further sound insulation to prevent noise nuisance.
A review hearing into its licence was adjourned by the licensing board on Thursday. Convener Rod Wallace moved adjournment of a decision on whether there were sufficient grounds to uphold complaints from an upstairs resident after hearing evidence from the pub’s tenants.
The board heard several complaints had been made to the council’s environmental health department over the course of a year by final-year medical student Mehdl Al-Dahlaki, who lives directly above the pub.
Mr Al-Dahlaki, who was not present at the hearing, complained of loud music, in particular from bass speakers, in addition to outside noise and disturbances in Old Hawkhill, which he claimed were related to Tally’s.
The board heard environmental health officer Ian Howe had visited the flat in August and, despite initial soundproofing works having been completed, including the installation of a false ceiling and noise limiters, the bass sound was clearly audible.
The matter had subsequently been brought before the board for consideration.
Solicitor Mary Crighton for Jimmy Marr of Park Leisure Ltd, which leases Tally’s from owners Green King Retailing Ltd, said Mr Marr had spent more than £7,000 on soundproofing measures which had not been successful.
Councillor Brian Gordon said he felt the pub should be given the chance to do further soundproofing works and Mr Wallace moved to adjourn the review until the January meeting of the board, which was agreed.
