Judge could ‘consider jail’ for man who went on racist tirade at Dundee takeaway shop

A man went on a racist tirade at a takeaway – months after being thrown out of a Dundee casino for abusive behaviour.

Kieran McInearney, 24, of Ladywell Avenue, avoided jail after admitting two offences.

At Dundee Sheriff Court, he admitted that on August 13, at Babu’s takeaway on Hilltown, he behaved in a threatening or abusive manner likely to cause fear or alarm, shouted and swore, acted in an aggressive manner and made racial remarks.

He was on bail at the time of the offence.

He also admitted that on May 27, at the G Casino on West Marketgait, he behaved in a threatening or abusive manner likely to cause fear or alarm, shouted, swore and made threats of violence – also while he was on bail.

Sheriff Lorna Drummond said she had read a background report and as he was currently on a community payback order, she could see a way to impose a non-custodial sentence instead of sending him to jail.

The sheriff placed him on a restriction of liberty order for four months for the casino offence, requiring him to remain in his home between 7pm-7am.

She also deferred sentence on him until March 6 next year, for him to be of good behaviour and ordered a progress report on his community payback order.

She told McInearney: “I will consider jail if there is no progress.”
