Angus nightclub boss fined for road rage assault

An Angus nightclub boss admitted punching a man after a road rage incident at Forfar Sheriff Court.

Kevin William Sivewright, of Perth Road, Dundee, admitted that on August 18 last year at New Road, Carnoustie, he assaulted a man by approaching him in an aggressive manner and punching him on the face to his injury.

Depute fiscal Hannah Kennedy told the court on Thursday that the assault by the 37-year-old happened after he was overtaken by another car.

She said: “The complainer is aged 17 and he and his friends were travelling to a football match in a car on August 18 at around 1.10pm.

“The accused’s vehicle was ahead of him and the complainer saw the opportunity to overtake.

“There is no indication that the complainer cut the accused up. It was a proper manoeuvre.

“Sivewright then indicated to the complainer to pull over and then overtook his car, again indicating for him to pull over.

“The complainer started to slow down when the accused cut in front of him and he had to perform an emergency stop.

“The complainer collided with the back panel of the Sivewright’s vehicle.

“Without warning the accused punched the complainer in the face in the mouth region, causing bleeding to the face, a swollen lip and soreness in the face.

“The police were then contacted.”

Defence agent Nick Markowski said Sivewright had been travelling with his wife at the time of the incident.

“Something happened and the two drivers found they had different views about what had happened,” he said.

“There was an argument and a confrontation and Mr Sivewright lost his temper. He doesn’t have any other outstanding cases. He got himself into certain difficulties after his first marriage ended in 2009 but he has moved on from that.

“He is now involved in various businesses, principally a nightclub in Arbroath.”

Sheriff Pino Di Emidio fined Sivewright £450, a reduction from £600 to take account of his early plea.
