Brothers jailed for pool cue assault on Brechin pub owner

Two Angus brothers who brutally beat a pub owner with a pool cue in his own establishment have been jailed.

Bolag Bar owner Frank MacDonald ejected Dale Forbes and his younger sibling Kane from the Brechin pub after they were refused service.

The pair retaliated with a “sustained attack” that left Mr MacDonald with a jaw broken in two places, a missing tooth, and a cut scalp on July 6 last year.

Fiscal depute Jill Drummond said Dale Forbes, a £3,500-a-month service technician in the offshore industry, had two previous convictions for assault to injury and possession of a weapon.

Kane Forbes, an apprentice joiner, had previous convictions for public disorder.

Ms Drummond said both men were regulars and were known to Mr MacDonald, who was not working in the bar but decided one of them was too drunk to be served more alcohol.

He ejected both men after they became agitated but CCTV recorded that the brothers immediately followed him back inside before repeatedly punching and kicking him.

Forfar Sheriff Court fell silent as a four-minute video followed the carnage around the bar and lounge area, before Mr MacDonald fell in a heap behind the bar.

The brothers took a pool cue and repeatedly hit him on the body while continuing their assault.

Defending Dale Forbes, Nick Markowski said the 31-year-old would lose his house and career if he was imprisoned.

Solicitor Angela McLarty said her client Kane Forbes, 28, was “embarrassed” by his actions and would not know how to explain the incident to his children.

Both solicitors conveyed their clients’ apologies to the bar owner.

Jailing the men for two years each, Sheriff Pino Di Emidio said: “There can be no excuse for the sustained attack which has taken place. The result was that Mr MacDonald required surgery on two occasions in relation to his jaw.

“The fact you were both extremely intoxicated is an aggravating factor.

“The only sentence that is open to me is imprisonment.”

After the sentence, Mr MacDonald said he can no longer feel part of his face due to the attack.

While he had hoped for a longer sentence, he was “satisfied” both men were going to jail for their crimes.

Dale Forbes, of Provost Buchan Road, Brechin, and Kane Forbes, of Noble Avenue, Invergowrie, both admitted an indictment alleging that they assaulted Mr MacDonald by repeatedly punching and kicking him on the head and body, repeatedly striking him to the body with a pool cue and repeatedly stamping on his head and body, all to his severe injury on July 6 last year.
