A late night Dundee kebab shop worker who was sacked for refusing to carry out a delivery after the end of his shift has been awarded compensation of almost £4,000.
John Porter (49) of Garvock Place was found by an employment tribunal to have been unfairly dismissed from his post at the Marmaris Kebab House in Nethergate.
He refused to deliver the order after trying repeatedly to check that it had been placed legitimately.
It had come in by telephone and he called the number several times to ensure the caller actually wanted the meal as the shop had been plagued by hoax calls.
There was no reply and he came to the conclusion it had been another hoax or had been placed by a drunk customer who had fallen asleep.
His boss insisted that he deliver the order, but it was past his 1am finishing time and the order could not be confirmed, so he refused. His boss responded by telling him in no uncertain terms that he was sacked.
Mr Porter raised proceedings against Hasan Cetinkaya, trading as Marmaris Kebab House, and gave evidence at a hearing on November 7.The case was adjourned to February 6, but Mr Cetinkaya did not attend on that day.
Tribunal judge J Hendry found in Mr Porter’s favour on all the grounds pursued.
These included unfair dismissal, unpaid wages, wages in lieu of notice and not having being given terms and conditions of employment. His total award came to £3,935.95.
