Father fined for shoving boy after snowball fight fright

A father assaulted a teenager after his young daughter was scared by a snowball hitting their window.

Michael Humphrey pushed the 14-year-old boy, who he believed had thrown the snowball, causing him to stumble and hit his head on a lamppost.

Perth Sheriff Court heard the 26-year-old had been watching television at home with his four-year-old daughter and two other family members when the snowball went astray.

Depute fiscal Bill Kermode told the court: “At 7.30pm the complainer and his friends were having a snowball fight on Mill Street, Kinross, near to the locus. One child accidentally threw a snowball at the accused’s window, hitting it.

“Michelle and Margaret Humphrey were with the accused and his child watching television when the snowball hit the window. The accused’s daughter got a fright and began to cry.

“The witnesses looked outside and saw a group of youths, some of which were running away. The accused left the house to go and speak to them.

“A short time later some of the children were standing at the locus when they observed the accused walking towards them.

“Three girls in the group recognised the accused as the male who had looked down from the window.”

Humphrey then confronted the group.

Mr Kermode said Humphrey walked towards the complainer and accused him of being responsible for throwing the snowball.

He added: “He then placed his hands on the complainer, one on his neck and one on his chest and pushed, causing him to stumble and strike his head on a nearby lamppost.

“The accused thereafter walked away from the locus. One child reported the incident to the police by telephone.”

Solicitor Cliff Culley, acting for Humphrey, said: “Where his flat is is a corner and youths tend to gather there and there have been problems.

“The throwing of the snowball did cause distress to his daughter.”

He said Humphrey had told the boy to stop throwing snowballs but did not intend to cause him harm.

Humphrey admitted assaulting a 14-year-old by pushing him on the body and causing him to strike his head against a lamppost on Avenue Road, Kinross, on January 13.

Sheriff Fletcher fined Humphrey, of Avenue Road, Kinross, £200.
