A court has ordered the destruction of an American Pit Bull type dog after it tried to bite a dog warden and Scottish SPCA inspector on separate occasions.

Dog owner Mark McLay, 35, of Cotburn Crescent in Burntisland, appeared at Kirkcaldy Sheriff Court on Tuesday and admitted one charge of being in possession of the dog and two charges of it being dangerously out of control, contrary to the Dangerous Dogs Act 1991.

On one occasion at Whitehill Kennels in Cowdenbeath, on June 17 last year, the dog attempted to bite a Scottish SPCA chief inspector.

American pit bulls are automatically destroyed under the current law.

In another instance just ten days beforehand, this time at McLay’s home in Burntisland, the dog attempted to bite a dog warden in the course of their employment.

In each case, Sheriff Timothy Niven-Smith described the animal as being dangerously out of control.

Sheriff Niven-Smith said the court has ordered the destruction of the dog, and he deferred sentencing for McLay until February 15 for the production of background reports.
