Friday court round-up — Child threat and one-minute police chase

A Kirkcaldy dad threatened to rip the head off a 12-year-old boy and “shove it up his dad’s a**e” over claims of bullying a young girl.

Kirk Smith raced up to the child, who cannot be named for legal reasons and pointed his finger in his face while shouting and swearing.

Kirkcaldy Sheriff Court heard the incident took place after the boys encountered the girl near a chip shop in Templehall.

Fiscal depute Dev Kapadia said: “There had been background issues with the female, regarding allegations of bullying.

“There was an argument and a member of staff asked them to move away.

“A short time later the accused drove to where they were and got out of the car.

“The complainer’s friend sensed matters were going to escalate and fled.

“The complainer was approached by the accused, who started shouting ‘Oi, you! I’m going to rip your head off and shove it up your dad’s a**e’.

“The was shouting and swearing and pointing his finger at the complainer.”

Scaffolder Smith, 36, then drove off, leaving the boy shaken.

Smith’s solicitor said the girl had called his client after the boy called her names, including “slut”.

Smith, of Hayfield Road, admitted behaving in a threatening and abusive manner on the town’s Beauly Place on May 11 2021 and was fined £170.

Shooting death trial begins

The trial has begun of an Italian hunter accused of killing another man in the Carse of Gowrie in 2019.

Dundee High Court heard a joint minute of agreed evidence stating Franco Moroni fired the shot which killed Marco Cavola at Rossie Estate as they hunted pigeons.

However, Moroni denies charges of culpable and reckless conduct which caused the death.

‘One-minute police chase’

A 39-year-old Fife driver led police on a high speed “one minute chase” after being pulled over for having no insurance.

At Dunfermline Sheriff Court, Daryl Anderson pled guilty to driving his Honda Civic dangerously in Kelty including  travelling at more than three times the limit on frosty and icy roads on December 28 2020.

Procurator fiscal depute Jill Currie said Anderson’s car was stopped by police on Kelty’s Station Road after an insurance check.

The fiscal said the Honda “started to wheel spin” and was driven off at high speed as an officer approached.

Ms Currie said Anderson reached around 60mph – twice the speed limit – and did not stop at a mini-roundabout and drove between 60mph and 70mph on Cocklaw Street, while overtaking cars.

He continued at similar speeds along Union Street – a 20mph zone – before travelling along Keltyhill Road and turning right and entering a field.

The fiscal said: “Police were able to apprehend the accused. The pursuit lasted one minute”.

Anderson pled guilty to driving dangerously and without insurance.

Defence lawyer Calum Harris said Anderson had bought the car that same day but the seller was still registered on the insurance policy.

The solicitor said his client sped off because he felt he had penalty points on his licence.

His last driving conviction was in 2010.

Anderson, of Kelty’s Centre Street, was banned from driving for three years, fined £200  and told him to carry out 100 hours of unpaid work.

Carer thief

Carer Alan Brand went on a £4,000 spending spree with a bank card belonging to an 68-year-old, wheelchair-bound woman he looked after. He made more than 20 illicit purchases, including at self-service machines in various shops around Dundee.
