A serial offender who was arrested after shouting at “thin air” has been placed on a curfew and tag.

Joel Justice, 31, injured one of the police officers arresting him at Kandy, Seagate, late last month.

Justice was also found in possession of cocaine and acting in a threatening and abusive manner when he was picked up by police on March 29.

He struggled violently with PCs Matthew Sneesby and Jenna Wighton, injuring the latter.

Defence solicitor Mike Short previously told Dundee Sheriff Court the conviction for drug possession and police attack would “upset his mum”.

Sentencing

Justice, of Bellefield Avenue, admitted uttering threats of violence to “persons unknown”, possessing class A drug cocaine and repeatedly flailing his arms while struggling violently with officers, injuring one of them.

He appeared at Dundee Sheriff Court from custody.

He was sentenced by Sheriff Mark O’Hanlon to 18 months supervision, 100 hours unpaid work and a restriction of liberty order, keeping him housebound from 7pm to 7am for six months.

This was reduced from nine months in light of his early plea.

Past crimes

Justice has previous convictions for police assault and racial abuse.

In 2018 he acted in a racially aggravated manner likely to cause alarm and distress to PC Wojciech Maciesowicz, shouted and swore and made racist remarks.

He said to PC Maciesowicz: “Are you Polish?”

“F*** off back to Poland, this is Scotland, Polish *******.”

Justice also admitted assaulting PC Gary Cargill on the same date by spitting on him at police HQ.

He also made racist remarks and shouted: “No Islam in Europe” and “Kill all Muslims”.

Justice received two convictions for racially abusing take-away staff at different restaurants in Dundee in an 18-month period, from 2016 to 2018.
