A man found with a knife used to help construct a trampoline in Montrose was warned that he faces a “significant” custodial sentence.
Kevin James Paton, 38, a prisoner at Perth, admitted that on August 22 at an address in Glenesk Avenue he assaulted a man by repeatedly punching him to the head and repeatedly kicking him on the body to his injury while on bail.
He also admitted possessing a knife while on bail.
Addressing Sheriff Gregor Murray at Forfar Sheriff Court, defence agent Billy Rennie said: “In relation to the assault there wasn’t significant injury and the charge is more akin to a summary complaint rather than on indictment.
“He saw the complainer and there is a family history.
“That leads to words and what he has pled guilty without much injury.
“The knife was found in his possession when police arrived in relation to the assault charge.
“He had been putting up a trampoline earlier that day using the knife and had put this in his jacket.”
Mr Rennie said his client had been doing “everything he could” to make changes to his life after spending the majority of his adult life in prison.
“He comes from a good family and feels like he is letting them down,” he said.
He asked Sheriff Murray to consider calling for a social work report to see if there was any alternative to custody.
“He has been remanded since August 23 in relation to this case,” added Mr Rennie.
“He is by no means unintelligible and has insight into what he is facing today.
“He knows that if reports are ordered then he won’t get bail.
“It might just be delaying the inevitable but it might be good to get a fuller picture.”
Sheriff Murray agreed to defer sentencing until December 15 but told Paton: “I am prepared to consider anything else but the likelihood is you are going to receive a very significant custodial sentence.”
