Tuesday court round-up — Dundee firearms cops and MSP racially abused

A pair of women have appeared in court in connection with the death of a security guard in Kirkcaldy.

Nicola Gordon, 35, and Teresa Gordon, 57, appeared in private in the town’s sheriff court on Monday.

Both faced charges of culpable homicide and shoplifting.

Neither woman entered a plea and their cases were continued for further examination.

Both women, from Kirkcaldy, were released on bail.

The incident relates to the death of a 62-year-old man at the Rejects store on St Clair Street shortly after noon on Friday.

A Police Scotland spokesperson said on Monday night: “Emergency services were called around 12.20pm on Friday, 6 January, 2023 but the man was pronounced dead at the scene.

“A third woman, aged 18, was arrested and charged in connection with shoplifting during the same incident.”

Crash recalled

The survivor of a fatal road crash in rural Angus told a court of the moment her car collided with a tractor and trailer which crossed into her path. Dorothy Stables, 71, recalled the “terrifying” collision, which killed backseat passenger Linda Thomson, as she gave evidence at a special reasons hearing in Forfar. Tractor driver, Duncan Lamond had admitted causing death by careless driving but is seeking to hold onto his driving licence.

Dundee firearms call-out

Firearms officers were called to a property in Dundee on new year’s day after a man locked himself in a kitchen with a knife and hammer.

Dundee Sheriff Court heard Ryan Paul, 23, had fallen out with family members after drinking while having an unspecified condition.

His dog had been put down following an incident involving his brother and when police were called they found Paul, of Ballindean Road, holding a pair of scissors and threatening to harm himself.

Depute fiscal Emma Farmer told Dundee Sheriff Court: “Throughout the incident they observed the accused in possession of a knife and hammer.

“A firearms incident was declared.”

At 7:50am – around 90 minutes after police were called – the accused gave himself up.

Defence solicitor Anika Jethwa, in mitigation “is very remorseful” and “appreciates now he cannot drink with his condition.”

Sentence was deferred until February 8.

Hit and run

A speeding hit and run biker who sent a Dundee schoolboy flying and left him with a severe eye injury has been given unpaid work. Unqualified rider Stephen Bell, 36, was caught after leaving his distinctive Tweety Pie helmet and a shoe behind as he fled from the scene of the crash.

Ex-MP crime proceeds delay

Prosecutors seeking £130,000 from recently-released Natalie McGarry will have to wait for her appeal against conviction and sentence.

McGarry, 41, from Inverkeithing, was jailed for two years at Glasgow Sheriff Court in June this year.

She was found guilty of embezzling £19,974 while treasurer of Women for Independence and £4,661 while treasurer, secretary and convener of the Glasgow Regional Association of the SNP.

McGarry – who denied the accusations – was the MP for Glasgow East between 2015 and 2017.

She was released after a successful application to appeal her conviction and sentence in December 2022.

Appeal proceedings will begin in two weeks and are expected to proceed substantively in February.

McGarry was not at Glasgow Sheriff Court for a proceeds of crime hearing on Tuesday.

However, her lawyer Pat Campbell said: “This strikes me as ambitious and contrary to my experience in these matters.

“I am inviting the court to continue these matters for maybe six weeks maybe longer would be more of practical value.”

Sheriff Barry Divers continued the matter for eight weeks.

Stroke delay

A jailed drugs trafficker who previously asked a court to postpone proceedings so he could visit an Apple store is in a “bad way” having suffered a stroke. William Binnie, 51, from Fife, is facing proceeds of crime action but it has now been delayed. He previously asked for time from prison to get a laptop unlocked which he says proves he made money from activities other than drug dealing.

Dundee attempted murder charges

A pair of Dundee men have appeared in court accused of the attempted murder of a 37-year-old in a city multi.

Gary Thoms, 39, and James Anderson, 45, appeared in private at Dundee Sheriff Court.

Both were accused of assault to severe injury, permanent disfigurement and danger of life and attempted murder, as well as robbery and weapon possession.

Neither man entered a plea, the case was continued for further examination and both were remanded.

It comes after an incident at the Dallfield Court multi on January 5.

In its aftermath, police would confirm only that a 37-year-old man had been taken to Ninewells Hospital and the extent of his injuries have not been made public.

Pervert at it again

A Dundee creep who sexually assaulted a woman and flashed a teenager on the same night will be on the Sex Offenders Register for a decade. Jason ONeil has a history of sexual crimes, including sharing a private video of a woman performing a sex act on him.

SNP ‘supporter’ abused minister

An SNP “supporter” who called then-justice secretary Humza Yousaf a “racist piece of s***” in an abusive email has been placed under supervision for a year.

John Conquer, 65, of Kilmarnock, sent the message to a constituency office in Glasgow’s Cardonald on April 11 2020 after viewing a right-wing outlet’s video commenting on a hate crime bill speech by Broughty Ferry-based Mr Yousaf.

The email said: “Watched the latest Rebel News video on YouTube, you are the main subject.

“Only because you are a piece of racist scum.

“We don’t need people like you in Scotland stirring up racism in Scotland you racist piece of s***.

“I will share the Rebel News video to everyone to show what a horrible b****** you really are.”

The matter was reported and Conquer was traced and arrested.

He told officers: “I’ve got a funny feeling this might have something to do with my political beliefs.

“It’s the only thing I can think of because I don’t do anything.”

Conquer pled guilty at Glasgow Sheriff Court to behaving in a threatening or abusive manner.

The charge was “racially aggravated.”

Graham Cunningham, defending, told the court his client is an “SNP supporter” who has health problems.
