Rapist attacked sleeping woman in Fife

High Court in Edinburgh
Donnelly was jailed at the High Court in Edinburgh.

A rapist who phoned the police after he attacking a sleeping woman in Fife has been jailed.

Luke Walker, 24, preyed on his victim at a location in Lochgelly on an occasion between March 14 and 16 2020.

The High Court in Edinburgh heard the woman describe how she was unable to give consent but woke to find him assaulting her.

Jurors heard how Walker told her that he was “really, really, really” sorry for his actions.

He said he thought she was awake, had given consent and had stopped the moment he was told to stop.

The court heard Walker, of Blackpool, Lancashire, later contacted police who launched an investigation.

Officers found enough evidence to bring to court and on Thursday, jurors convicted Walker of rape.

Abused twice in same night

The story emerged following a short trial at the court.

Walker had denied any wrongdoing.

His victim – a 24-year-old woman who cannot be named – told the court she met him on an online dating app.

She said she had gone to sleep in a house but had woken up to find Walker abusing her.

“I told him to stop.

“I went through to the living room and sat there for a couple of hours to clear my head.”

The woman said that she later returned to the bedroom and fell asleep.

However, Walker started abusing her for a second time.

She said: “It caused me to waken up.

“I pulled his hand away and told him to stop.

“He then stopped doing it.”

Describing how she felt, the woman said: “I just sat and cried.”

Text apology

The woman told the court she later left the house to get away from Walker.

She stayed with a loved one and sent texts to him detailing her feelings about the abuse.

The court heard that Walker replied: “I said I was sorry and I was really, really sorry and it never happened again.”

Walker later contacted the police.

The woman’s sister also told the court Walker spoke to her following the attack.

He said that he had sex with her sibling.

The witness, who also cannot be named for legal reasons, said: “He said he had sex with my sister.

“He said that he had slept with my sister when she was asleep.

“He said that he didn’t think she was asleep.

“He didn’t think he had done anything wrong.”

Jurors returned a guilty verdict on the rape charge.

Judge Lord Young remanded Walker in custody.

He will be sentenced at the High Court in Edinburgh later this year.
