Hilltown mum poured booze on police and threw cans at them from roof of flat

A Hilltown mum poured the contents of her booze cans over police from the roof of her flat before “recklessly” launching the tins over the railings during a drawn-out incident last summer.

Hayley Marshall, 35, slept in for her sentencing hearing at Dundee Sheriff Court and almost had a warrant issued for her arrest.

When she did appear, Marshall admitted “donkey” kicking police who arrived at her Stirling Street home after her abandoned 999 call mentioned “jumping off” a veranda.

Officers arrived at around 3:55am on July 12 last year and found the accused singing and sitting on the veranda with her legs dangling, some 25-feet from the ground.

The first attack happened in Stirling Street, Dundee.

Early morning police attack

Depute fiscal Lora Apostolova told the court: “The accused saw the officers and climbed the railings.

“They were met with a torrent of abuse.

“They arrived at the accused’s door. PC Reid attempted to speak about the 999 call.

“She told officers if she wanted to jump she would ‘do this’, before she climbed (more) railings.”

The court heard officers approached her, before she raised her right leg and kicked in a “donkey style”, hitting them on the legs and body.

She then threw her head back before spitting at the police. The spittle landed on their bodies.

Ms Aspolotova said: “The accused began to throw cans of alcohol from the roof, with no concern about where the cans landed.”

Lochee High Street assault

The court heard of a second incident in September that year on Lochee High Street, in which Marshall struggled with police following a disturbance, before spitting at them.

After her arrest, she then “lunged” at PC Kasey Milne at Bell Street HQ and attempted to headbutt her.

Defence solicitor Jane Caird apologised on her client’s behalf for almost missing the sentencing, explaining her alarm had run out of battery.

She added: “She accepts she does have a record of previous convictions but she has not faced a custodial sentence before now.

“On that basis I would call for reports to be made.

“I would say, after the second incident she spent a period of seven days on remand.

“It provided her with a stiff wake-up call.

“She has no other matters outstanding, she has done exceptionally well.”

Sentence deferred

Sheriff Jillian Martin-Brown deferred sentence for criminal and social work reports and a restriction of liberty order, warning Marshall her offences did creep into the “custody zone.”

Marshall admitted on July 11 2021 assaulting PC Mark Reid and culpably and recklessly throwing tins of liquid from a roof.

She further admitted on September 25 that year assaulting PCs Mark Heggie and Gemma Gill, repeatedly kicking them and spitting at their bodies, assaulting PC Andy Barrie and attempting to headbutt PC Kasey Milne on Lochee High Street and Bell Street headquarters.

She will return for sentencing on January 18.
