Flailing Dundee pub-goer caused glass shards to hit man’s eye

Craig Brett, 49, flailed his arms around as he was leaving the Arctic Bar in Dundee and knocked over a stack of dirty glasswear.

A disgruntled drinker launched broken shards of glass into a man’s eye after being asked to leave a pub over a previous fracas.

Craig Brett, 49, flailed his arms around as he was leaving the Arctic Bar in Dundee on April 22 last year and knocked over a stack of dirty glasswear.

Some of the glasses smashed as a result and tiny fragments of glass flew across the bar and into the eye of innocent bystander Ian Andrews.

Brett, from Dundee, admitted culpably and recklessly flailing his arms and striking a stack of glasses, causing them to smash and for shards to fly into Mr Andrews’ eye.

Fiscal depute Lee Corr told Dundee Sheriff Court: “A witness who was working as a barmaid asked the accused to leave because of something that had happened.

“As he was leaving, he swung his arms around, knocking a stack of glasses on top of the bar, and causing several of them to smash.

“Glass shards went in the direction of Mr Andrews and several small pieces went into his right eye. He was ushered from the premises and police were called.”

The court was told that Mr Andrews was treated at the scene by paramedics, but refused hospital treatment and it was unknown what, if any, damage had been done.

‘Drink played a part’

Solicitor Gary McIlravey, defending, said: “He genuinely recognises the serious potential consequences of his actions. Drink played a part.”

Sheriff Gregor Murray placed Brett on a curfew for five months and under social work supervision for a year.

He told Brett: “I want to make it clear to you that the degree of recklessness in what you did in the bar makes it fortunate for you that there is no medical evidence available.

“I have taken account of the fact you have stopped drinking. Having regard to your record and the background, this may amount to your last chance.”
