Tuesday court round-up — Road rage and back to the Baltics

A round-up of court cases from Tayside and Fife.

Kelty man David McKay, 33, left another driver and passenger “terrified” during a road rage episode at the Kincardine Bridge.

He became abusive in a layby during a confrontation after another incident, which was not detailed in court.

Procurator fiscal depute Lee Corr told Dunfermline Sheriff Court McKay “suddenly became volatile” and “placed his head against the witness’s forehead” and shouted aggressively.

The other driver’s 16-year-old granddaughter was in the car and was upset by the behaviour.

Mr Corr said the other driver made his way back to his car and McKay followed him, shouting, then opened the car door and shouted into it.

The fiscal depute said the other driver and passenger were “terrified by this”.

Police attended and told McKay he would be charged, to which he replied: “f**k off”.

McKay, of Croall Place, pled guilty to behaving in a threatening or abusive manner on the A985 on March 14 last year.

Defence lawyer Calum Harris said the “rather unpleasant scene” had arisen out of a matter “no longer before the courts” for which McKay felt he was not at fault.

Mr Harris said his client, a mechanic, did not see the 16-year-old in the car at the time and regrets his actions more so after finding this out later.

He was fined £350.

Murder accusation

Caleb Ferguson, 18, appeared in court accused of murdering Perth man Cameron Rae. He faces allegations he killed the 20-year-old by stabbing him repeatedly with a knife or similar weapon at a flat in the city’s South Methven Street at the weekend. He is further accused of assaulting two other people whose identities are unknown to prosecutors by punching and kicking them on the head and body. He made no plea.

Baltic return

An abusive boyfriend smashed up household items during a “frightening” outburst at his Scone home.

Eriks Kurovskis, 44, admitted behaving in a threatening or abusive manner in his former home near Scone on March 11 this year.

Fiscal depute Andrew Harding said Kurovskis and his partner had been together for 19 years and moved to Scotland in 2009.

He said the accused had been out for the night, drinking and returned home and began complaining about his broken phone.

“The accused then went into the living room and was shouting and swearing.

“He took a framed photo and threw it against the wall, causing it smash.”

He went on to smash items in the kitchen.

His girlfriend called a friend, who tried to calm Kurovskis down but it made him worse and police were called.

Solicitor Angela McLardy, defending, said: “He feels that this was a minor incident that became exacerbated” and blamed his mood on work stress.

She said the relationship is over and he intends to return to Latvia.

Sheriff Francis Gill told Kurovskis: “This was clearly a frightening and upsetting incident for the complainer… your behaviour was simply unacceptable.”

The sheriff fined him £400, taking into account he had been remanded for a month.

Sweet justice

A Fife woman who stole £18,000 from an award-winning chocolate fountain firm to spend on Amazon goods is behind bars. Elaine McCall, 51, pled guilty to embezzling the money from Sephra Europe Ltd while an employee at the firm’s Kirkcaldy site, between March 2019 and March 2020.

Case deserted

Court proceedings against a Perth man accused of a vicious assault at a city centre pub have been deserted.

Andrew McGregor was charged with attacking a female member of staff at the Sandeman pub, Kinnoull Street, on April 2 last year.

It was alleged the 29-year-old, of Newhouse Road, had injured the woman – while she was working – by seizing her by the head and body with both hands, repeatedly punching and kicking her on the head and body, biting her on the body and pulling her down a set of stairs.

The case was deserted pro loco et tempore when it called before Sheriff William Wood.

The sheriff was told the trial had already been adjourned on more than one occasion.

He told McGregor: “The Crown has made the decision to desert this case.

“That means it could be brought back but in the meantime, these proceedings are at an end.”
