A fight involving at least five men took place outside a Fife shop at 2pm and was fully captured on CCTV.
The video was shown in court and depicted what had started off as a boxing style “square-go” ending up with one man coming off worse and being punched to the ground, kicked and dragged.
Dunfermline Sheriff Court – where the three men appeared for sentencing – heard the bust-up in Ballingry was the culmination of long-standing ill feeling between the men involved.
In the dock were James McDonald, 30, of Kirktoun Park, Ballingry, his father George McDonald, 49, of Malcolm Street, Ballingry, and David Winiarski, 25, of Croall Place, Kelty.
The McDonalds had both previously admitted that on March 25 last year at the Nisa store, Benarty Square, Ballingry, while acting with others, they assaulted Dylan Richardson, by repeatedly punching and kicking him on the head and body, causing him to fall to the ground and dragged him along the ground, all to his injury.
Winiarski had admitted assault by repeatedly punching and kicking Mr Richardson on the head and body.
The court was told that Winiarksi had gone to the fight scene after receiving a phone call telling him what was going on outside the shop.
After watching the CCTV evidence, Sheriff Craig McSherry told all three that their conduct would have merited custodial sentences.
However, he instead imposed community payback orders.
James McDonald will carry out 240 hours of unpaid work, George McDonald will do 200 and Winiarski was given 160.
