Afternoon-after Angus drink-driver twice the limit after overtaking cop car at 90mph

A day-after drink driver who overtook an unmarked police car at more than 90 miles per hour has admitted his “100% guilt”.

Samuel Menzies had been drinking the night before but believed a 12-hour gap was enough to allow him to get back behind the wheel.

But the Angus retiree discovered he was still nearly twice the legal limit at 1pm the next day when cops pulled him over in his Mercedes on the Arbroath to Dundee dual carriageway.

The 66-year-old retiree represented himself at Forfar sheriff court, pleading guilty to the January 7 offence of driving on the A92 with an excess alcohol count of 43 microgrammes – the legal limit is 22 – after he was clocked at 92mph.

Depute fiscal Bill Kermode said: “At 12.55pm police were on patrol in an unmarked car and their attention was drawn to a silver Mercedes approaching at excessive speed.

“The vehicle overtook the police car so they operated the VASCAR equipment and a speed of 92 miles per hour was recorded.

“A roadside breath test proved positive and a further test at the police station gave the reading of 43 microgrammes.

“The accused was charged and made no reply,” said Mr Kermode.

In response to Sheriff Pino Di Emidio over what plea he intended to enter to the charge, Menzies, of Millgate Loan, Arbroath told the court he was “100% guilty”.

“I made a grave error of judgment regarding my alcohol intake,” he said.

“I had a heavy night on Friday night and obviously well misjudged it.

“It was over 12 hours since I last had a drink, but I made a grave error of judgement in both regards and I apologise.”

Sheriff Di Emidio fined Menzies a total of £600 and banned him from the road for a year.
