Tuesday court round-up — When witnesses let you down

A Montrose man who could not accept his relationship was “over” pushed his former partner in a domestic argument.

Stephen Craig, 31, of Annat Road, repeatedly swore and shouted at his ex, before pushing her, days before Christmas last year.

He then broke bail conditions banning him from her home on Inch Terrace by making contact with her.

Depute fiscal Andrew Harding told Forfar Sheriff Court: “Just prior to the incident, on December 13, the complainer told him their relationship was over.

“He did not take it well.”

On December 20, he spent the day at the house but left for a walk and when he returned, his partner would not let him back inside.

He began to shout and swear, placed his hands on the complainer’s shoulders and pushed her.

Police were contacted.

On January 14 he breached his bail conditions by contacting the complainer, who was upset.

Defence solicitor Nick Markowski, in mitigation for Craig, said: “He is apologetic.

“The relationship had broken down. He knows the relationship will not continue.”

Non-harassment breaches from prison

Fife domestic abuser Gordon Thomson breached a non-harassment order by calling  his victim with phone calls as soon as he was jailed. Thomson was jailed for 41 months and a non-harassment order was imposed until 2026. He breached it continually and has had more prison time imposed.

Case deserted

Court proceedings against a man and woman accused of a vicious assault in Perth city centre have been formally shelved.

Jeanine Burns and Danny Black were due to stand trial at Perth Sheriff Court.

They were accused of behaving in a threatening or abusive way in the city’s Market Street on January 5, 2021.

It was alleged the pair, both from Perth, approached Connie Furlong while she was sitting in a car, attempted to force their way inside while shouting, swearing and acting aggressively.

They were further accused of acting together and assaulting Samantha Rae, by seizing her, causing her to fall backwards and striking her head against the ground.

They both denied charges.

Fiscal depute Matthew Kerr told the court both complainers had failed to attend court for trial and made a motion to adjourn the trial to a later date.

Solicitor Paul Ralph, representing Mr Black, said: “Both of these women are well known to the court and they would be well aware of court procedures.

“On that basis, we would oppose the Crown’s motion.”

Sheriff Alison Michie agreed and deserted the case pro loco et tempore, meaning it has been dropped but could be returned at a later date.

Coked-up driver

A gurning delivery driver was nearly 10 times the drug-drive limit when he was caught outside Perth police station – three days after he took cocaine at a pal’s stag do. Alexander Mordente could not control his jaw and was speaking incoherently when he was questioned by officers at a filling station next to their Barrack Street HQ.
