Mossmoran ethylene plant in Fife is facing legal action after being reported to prosecutors by Sepa.
The environmental protection agency reported operators ExxonMobil to the Crown Office and Procurator Fiscal Service over unplanned flaring last April.
The incident, which was visible across Fife and beyond, racked up over 900 complaints.
An ExxonMobil spokesperson said: “Having only received the communication from SEPA late this evening, we will now take the time to fully consider its content.
“Wherever we operate, we comply with all applicable laws, rules and regulations.”
